“Kasuwapangan” ng mga cellphone companies, pinaiimbestigahan ni Bueser

San Pablo City—”Hindi makatarungan ang pagpapataw ng expiration period sa mga prepaid cards at e-load na ibinebenta ng mga cellphone companies,” ito ang buod ng House Resolution No. 302 na isinumite ni Congressman Danton Q. Bueser (LP, 3rd District-Laguna) sa Kongreso kamakailan.

Pangunahing layunin ng nasabing House Resolution na “Investigate in aid of legislation the unjustly short expiration periods of electronic cellular phone loads and transferred load credits that effectively make the puportedly affordable services actually prohibitive to the ordinary prepaid cellular phone subscriber.”

Sa panayam ng DERETSO kay Bueser kamakailan, sinabi nito na “pinalalabas ng mga cellphone companies na nakakamenos sa mga prepaid cards at e-load subalit sa katotohanan ay mas mahal ito sapagkat pinupuwersa ang cellphone user na ubu-sin kaagad ang load sa nakatakdang panahon. In effect, minamanduhan ang mga subscriber na gamitin iyon oras-oras kahit na nga hindi kailangan sapagkat ma-wawalan na iyon ng saysay pagsapit ng takdang panahon.

“Papaano kung ang halagang 25 pesos na ikinarga ay kayang pata-galin ng kahit isang buwan sapagkat talagang sa mga mahahalagang komunikasyon lamang nagagamit iyon? Dahilan na rin sa halos isang araw ang expiration period noon, mapipilitan tuloy gamitin iyon kahit sa hindi mahahalagang komunikasyon. Marami rin ang nagparating sa akin ng mga reklamo na may pagkakataong nauubos na kaagad ang low denomination na ikinarga sa pamamagitan ng e-load kahit na nga nakakaisa pa lamang gamit noon.

“Ano ang bottomline? Luxury at hindi necessity ang konsepto ng pagkakaroon ng expiration period sapagkat nagreresulta iyon sa paggastos ng sobra-sobra ng may mahigit sa 25 milyong subscribers, na ang karamihan naman dito’y mga ordinaryong tao na pinipilit lamang maka-agdon sa pang-araw-araw nilang buhay.”

Napag-alaman naman ng DERETSO na kasalukuyang may nakahayin ng ganoong usapin sa National Telecommunications Commission.

May pag-asa pang makolekta

Sa usapin ng “utang” ng SPCWD sa Lunsod

San Pablo City—May posibilidad pang makolekta ng lunsod na ito ang “3%” mula sa “gross annual sales” ng San Pablo City Water District matapos na magpalabas ng legal opinion hinggil dito si city legal officer Atty. Eleno Mendoza na nakasaad sa kanyang October 8, 2004 letter na ipinadala kay Konsehal Maria Evita R. Arago.

Si Arago ang chairperson ng committee on water resources and development ng Sangguniang Panglunsod.

Nakabatay ang nasabing “pagkolekta ng 3%” sa Resolution No. 309 na naaprubahan noong pang December 17, 1973 kaugnay naman sa paglikha ng San Pablo City Water District mula sa dating San Pablo Water System.

Ayon sa nasabing Resolusyon, “the transfer of all existing water facilities from the San Pablo Waterworks System to the San Pablo Water District provided that pursuant to Section 31 (b) of presidential Decree No. 198, the latter shall pay unto the City of San Pablo, in lieu of taxes an amount of 3% of its gross annual sales to be paid annually to the City at the end of its Fiscal Year not later than July 31st of the following Fiscal Year.”

Sa panayam ng DERETSO kay Mendoza, sinabi nito na, “Malinaw ang isinaad ko sa aking liham, mabuti nga at binuksan na ang usaping ito (ni Arago) upang mapag-isipan ng ating local government ang prosesong gagawin sa pagsingil ng 3%. I am at the service of the city government of San Pablo kaya’t laging first and foremost sa akin ang kapakanan ng lunsod, lalo na’t may kinalalaman ‘yon sa pagpapataas ng kita ng siyudad. Subalit dapat nating tiyakin na lahat ng gagawin natin ay nakabatay sa batas at umiiral na mga regulasyon.”

Sa ipinaabot namang mensahe ni Arago sa DERETSO, ipinaalam nito na “hindi siya (Arago) kumbinsido sa nasabing legal opinion ni Mendoza.” Sa initial na pagsusuri pa ni Arago, batay na rin sa nasabing liham, “may kiling pa si Mendoza sa water district.” Hindi naman tinukoy ni Arago ang kanyang konkretong dahilan kung bakit nga ba “hindi siya kumbinsido.” Sinabi pa nito na maghahayag siya ng full statement kapag nakakuha na siya ng iba pang legal opinion sa iba pang legal group.

Madam Chairperson:

This pertains to your October 01, 2004 letter, requesting the undersigned to render a legal opinion on the conflicting interpretation relative the intent of City Council Resolution No. 309, series of 1973, on whether or not to obligate SPCWD to pay the City Government (sic) as a result of the latter’s use of the City’s natural wealth which is the water resource of San Pablo City.

PREFATORY

Ownership of all water of the Philippines belongs to the State. Article XII, Section 2, of the 1987 Constitution provides, inter alia, viz:

“Section 2. – All lands of the public domain, waters, minerals, coals, petroleum and other mineral oils, all forces of potential energy, fisheries, forests or timber natural resources are owned by the State. xxx in cases of water rights for irrigation, water supply, fisheries, or industrial uses other than the development of water power, beneficial use may be the measure and limit of the grant. xxx” (Italics & format ours)

Adopting the principle of Jura Regalia (Regalian Doctrine), that all things under its control is owned by the king, the State enacted several pieces of legislation in the utilization and development of these resources; water resources laws we shall cite. PD No. 1067, otherwise known as the Philippine Water Code, which provided for a decree instituting a water code, revising and consolidating the laws governing the ownership, appropriation, utilization, exploitation, development, conservation and protection of water resources. PD No. 1067 thus, reiterated the principles enshrined in Section 2 of the Article XII of the Constitution when it provided in its preamble, that all waters of the Philippines belongs to the State. Article 5 of PD No. 1067 in the same vein likewise provides:

“Article 5 – The following belong to the State:

a) River and their natural beds;

b) Continuous or intermittent waters of springs and brooks running in their natural beds and the beds themselves;

c) Natural lakes and lagoons;

d) All other categories of surface water such as water flowing over lands, water from rainfall whether natural or artificial and water from agricultural runoff, seepage and drainage;

e) Atmospheric water ;

f) Subterranean or ground water; and

g) Seawater.” (Italics & format ours)

The case in point, Presidential Decree 198 on the other hand, was enacted for the purpose of declaring a national policy favoring local operation and control of water systems; authorizes the formation of local administration of such districts; chartering a national administration such powers as are necessary to optimize public service from water utility operations.

For purposes of discussion, we shall confine ourselves to the chief issue, which is:

THE INTERPRETAION OF THE IN LIEU PROVISION EMBODIED UNDER SECTION 30 (b) PD No. 198, AND AS ADOPTED IN CITY COUNCIL RESOLUTION No. 309, SERIES OF 1973.

DISCUSSION

That Supreme Court on several occasions had ruled, that charters, franchises, or contracts granted by law which contains the magic words IN LIEU provisions means, in exchange for something taken or provided. The particular provision is found in Section 30(b) of PD No. 198, which provides, viz:

“Section 30(b) – In-lieu Share. – As an incident in the acquisition of existing water system of a city, municipality, or province, a district may enter into a contract to pay in-lieu share for such utility plant, an annual amount not exceeding three percent (3% ) of the district’s gross receipts from water sales in a year: provided, however, that no contract of this nature shall be executed during the first five (5) years of the existence of the district; and provided, further, that the Board of Directors shall determine that such contract will not adversely affect or impair the fiscal position and operations of the district as verified by the administration. ( As amended by Section 11, PD No. 768; Section 5, PD No. 1479 ).” (Italics & format ours)

The In-lieu phrase found in the above- quoted provision is an incident to the acquisition by the SPCWD of the existing facilities, assuming there are, and refers to the payment by the latter of the value of the utility plants or facilities previously owned by the City and transferred to the SPCWD by virtue of the take-over by the latter pursuant to PD No. 198. It must be emphasized that before the advent of R.A. No. 7160 in 1991, local government units were under the direct control and supervision of the national government. PD No. 198 emanated not from congress, but by virtue of the Martial Law Powers of then President Marcos. It was only in 1992 when the LGU’s acquired full autonomy; the aspect of control by the executive branch of government was removed paving the way for a limited administrative supervision. PD No. 198 grants the City Government the authority to collect from SPCWD by way of contract an amount not exceeding three percent (3%) of the district’s gross receipts from water sales in every year. It is high time the Honorable Chairperson has open-up this matter so that the process can be laid for the city government to collect what is due to it under the law.

With regard to the provision in Resolution No. 309, series of 1973, the imposition that SPCWD is required to pay three percent (3%) of its annual gross sales, the same is rendered nugatory based on the following, viz:

1) SPCWD under the charter creating it is exempt from payment of taxes.

“Section 46. Exemption from taxes. – A district shall (1) be exempt from paying income taxes, and (2) shall be exempt from payment of (a) all National Government, local government and municipal taxes and fees, including any facilities, filing, recordation, license or permit fees or taxes and any fees, charges or costs involved in any court or administrative proceeding in which it may be a party and (b) all duties or imposts on imported machinery, equipment and materials required for its operations. (As amended by Sec. 20, PD 768).” (Italics & format ours)

2) The Local Government Code exempts the SPCWD from payment of certain taxes.

“Section 193. – Withdrawal of Tax Exemption Privileges. – Unless otherwise provided in this code, tax exemption or incentives granted to, or presently enjoyed by all persons, whether natural or juridical, including government-owned or controlled corporations, except local water districts, cooperatives duly registered under RA No. 6938, non-stock and non-profit hospitals and educational institutions, are hereby withdrawn upon the effectivity of this Code.” (Italics & format ours)

Article 283 of the Rules and Regulations Implementing the Local Government Code of 1991 likewise provides:

“Article 283. Withdrawal of Tax Exemption Privileges or Incentives. – Unless otherwise provided in this Rule, beginning January 1, 1992, all local tax exemption privileges or incentives granted to and presently enjoyed by any person, whether natural or juridical, including GOCCs, are considered withdrawn, except the following:

a) Local water districts; xxx “ (Italics & format ours)

The aforequoted provisions of the LGC does not however, foreclosed the right of the City Government to collect from SPCWD other forms of taxes. It is submitted that facilities of SPCWD not directly involved in water extraction may be subject to realty tax.

Finally, on the observation of the Honorable Chairperson, that the intention of the ordinance ( should be resolution ), is to obligate the SPCWD to pay the latter’s use of the City’s natural wealth, in this case, the water resources of San Pablo City, the same is misplaced for the reasons stated in the prefatory. The city government never acquired dominion much more ownership in the water resources of San Pablo City the same being State owned, and regulated by the latter through various national government agencies herein mentioned.

Nagsilbing mga sponsor sa nasabing Kasalang Bayan ang lahat ng halal na opisyal ng lunsod na ito na siyang bumalikat ng gastusin sa pagdaraos nga ng nasabing okasyon.

Sina dating konsehal Jing Ramirez at Lorie Gilatco ng Mayor’s office at Konsehala Ivy Arago ang nanguna naman sa pisikal na pagsasaayos ng One-Stop. Si Arago ang siyang nag-emcee sa inihandang simpleng programa at siya din ang nagkonsepto sa ilang mga makabuluhang seremonyas.

Naging kapansin-pansin ang magandang naging kaayusan ng One-Stop na nagmukhang reception hall ng isang first class na hotel sa Kamaynilaan. Lahat ng mga ginamit na dekorasyon ay mula sa Siesta Residencia de Arago na mismong personal ding pinamahalaan ni konsehala Ivy ang pag-aayos noon.

Matatandaan na noon ngang madaling araw na iyon, nagkaroon ng komprantasyon ang grupo nina Beligan at mga taga-GMA7 kasama si Dodie Banzuela, associate publisher ng DERETSO hinggil sa ginawang election coverage ng mga taga-media, na kung saan, “ninakaw” diumano ng grupo ni Beligan ang DVD tape matapos na sapilitang kunin nito (Beligan) ang mini-video camera na gamit ng taga-GMA7. Sinapok pa diumano ni D’John, panganay na anak ni dating mayor Boy Aquino, si Nowell Cuanang, reporter ng Imbestigador.

Kinatigan ng Ombudsman ang ginawang preliminary investigation ni assistant city prosecutor Florante Gonzalez.

September 29, 2004 nang ganap na maaprubahan ni Deputy Ombudsman for the Military & Other Law Enforcement Offices ang nasabing Resolution.

Kasabay nito, ipinagutos pa ng Ombudsman na isailalim kaagad si Beligan “to administrative adjudication for Misconduct by this Office.”

Sa Sinumpaang Salaysay ni Judilla, inamin nito na siya ang “sapilitang kumuha” ng nasabing video camera at hindi si Beligan.

“Patunayan nila iyon sa Korte. Binalaan ko na sila noong madaling araw ng May 10 na quits na ‘lang kami tutal pare-pareho naman kaming gumaganap ng aming tungkulin sa bayan. Sabagay, kami totoong mamamayan ang kinakalangan namin noon, ewan ko ‘lang sila,” ayon kay Banzuela.

SPCWD employees, tutol na sa LWUA representative

San Pablo City—Naglabas ng isang pormal na pahayag ng pagtutol ang SPCWD Employees Association-Courage sa patuloy na pananatili ni Engr. Antonio Magtibay na kinatawan ng Local Water Utilities Administration (LWUA) bilang 6th member sa board of directors ng San Pablo City Water District.

Sa dalawang pahinang pahayag na pirmado ng 120 kasapi ng SPCWDEA, na may petsang ika-8 ng Setyembre, sinabi nila doon ang limang kadahilanan kung bakit pinaaalis na nila si Magtibay.

Una, “nakikiisa” sila sa “pagpapatupad sa adhikain ng pamahalaan na makatipid sa mga gastos na hindi na kailangan o puwedeng iwasan na hindi naman makakaapekto sa pagpapatakbo ng isang ahensiya ng gobyerno;”

Ikalawa, “dahilan na rin sa kinakaharap na kakapusan sa pananalapi ng distrito, makakatipid ang SPCWD ng may PhP 250,000 kada taon sa director’s fee na ibinabayad sa LWUA. Hindi pa kasama dito ang gastos sa gasoline at driver na sumusundo at naghahatid (kay Magtibay) tuwing may board meeting;”

Ikatlo, “napalagay si Magtibay kasama pa ang dalawang opisyales ng LWUA nang masuspinde ng tatlong buwan ng Sandiganbayan noong 2003 ang tatlong director ng SPCWD.” Natapos na ang nasabing suspension at nakaalis na rin ang dalawang opisyales ng LWUA, “subalit nanatili pa rin si Magtibay” bilang ika-6th member nga ng board of director ng SPCWD.

Ikaapat, “isa sa panuntunan sa pagkakaroon ng kinatawan mula sa LWUA ay kung delikwente sa pagbabayad sa kanila ng utang ang water district.” Sa pananaliksik ng employees association, “nakakabayad naman ng utang ang SPCWD batay na rin sa napagkasunduan.” Katunayan anila, “matatapos na ang inutang para sa Phase 1 Improvement Project.”

Ikalima, wala aniyang “naitutulong ang LWUA 6th member (na si Magtibay) para maibsan ang paghihirap ng mga kawani sa SPCWD at bilang engineer ay walang gabay na naibibigay sa mga kawani ng technical team para maisaayos ang daloy ng tubig sa San Pablo.”

Ipinadala sa LWUA central office ang nasabing pahayag noong ika-27 ng Setyembre at hanggang sa sinusulat ang artikulong ito ay wala pang kaukulang kasagutan ang nasabing ahensiya.

Pananaw ng DERETSO

Ano nga ba meron sa San Pablo City Water District at tila nga yata ang napapalagay na director doon ay ayaw ng umalis? Anong klaseng pulot-pukyutan meron doon upang lahat ng klase ng regulasyon at probisyon sa batas ay tahasang suwayin ng perceived honorable and decent men?

Walang nagawa sina Pablo’y nang magtaas ng taripa ng tubig nitong Agosto ang mga taga-SPCWD sapagkat ayon sa justification ng management ng distrito’y “pinakamura sa buong Southern Tagalog ang singil ng tubig sa San Pablo,” “gagastusin sa mga nakaplanong proyekto upang mapagbuti ang daloy ng tubig-inumin,” “matagal nang ‘di nagtataas ng singil ng tubig ang distrito,” etc., etc., etc.

Lahat ng mga mabubulaklak na dahilan ay tanggap na nina Pablo’y, subalit bakit ayaw aminin nina nunung brion, carding fabros, rudy estiva, aris mitra, lerma prudente, tonyo magtibay, rugir borja at tisi rivera na nilulustay nila ang pondo ng distrito sa paggastos sa mga nakahaing habla sa iba’t ibang korte?

Habang sina Pablo’y ay patuloy na kumakalam ang sikmura upang may maipambayad lamang sa kinunsumo nilang tubig ay heto ang mga nabanggit na mararangal na tao sa San Pablo’t halos linggu-linggo’y nagsasalo sa masarap na pagkain tuntunga’y once a week board meeting!

Napasaoli na ba ang ipinambayad na piyensa ni rugir nang ito’y dakpin ng NBI dahilan sa kanyang pagsunod sa kaanuhan nina nunung maraming taon na rin ang nakaraan? Naibalik na rin ba ni rugir ang ipinambayad na backwages kina Raquel Tolentino at Evelyn Eje na halos dalawang milyong piso batay na rin sa kautusan ng Commission on Audit at ng Korte?

Sa mata nina Pablo’y ay matagal ng iligal at squatter sa loob ng board room si nunung, at maging si rudy, mapabalik pa kaya ang lahat ng mga pondong nakuha ng mga ito sa distrito kapag napika na ang korte at ipatupad ang dapat ipatupad?

Hindi maiiwasan ng DERETSO na muli’t muli’y ungkatin ang mga nabanggit na usapin sapagkat hanggang sa sinusulat ang pananaw na ito’y hindi pa rin nareresolba ang mga kaanuhan sa nasabing ahensya ng pamahalaan.

Reyalidad ng paninindigan ni Cong. Danton Bueser

San Pablo City – “Dalawang tahirang congressmen ng Laguna ang nagpakitang gilas sa Malakanyang sa pagboto nila ng YES sa ganap na pagpatay sa impeachment process noong Setyembre 7, samantalang dalawa namang bagito ang matapang na humarap sa sambaanan at nagsabing NO.”

NANINDIGAN si Cong. Danton Q. Bueser para sa kaunlaran ng Ikatlong Distrito ng Laguna.

Ito ang naging lead ng DERETSO sa edition nito noong Setyembre 10–16, 2005 matapos ang kontrobersyal na pagbobotohan sa Kongreso hinggil sa usapin ng impeachment laban kay Pangulong Gloria Macapagal-Arroyo. Sina Congressmen Uliran Joaquin, 1st District at Danton Bueser, 3rd District ang Yes at sina Justin Chipeco, 2nd District at Benjamin Agarao, 4th District naman ang No.

The rest is history ika nga, sa usa-ping nabanggit. Subalit hindi dapat ganap na iwan ang kasaysayang iyon nang hindi nahihimay ang mga pangyayaring nagtulak sa apat na mambabatas ng Laguna na manindigan sa kanilang paniniwala. Partikular na dapat pagtuunan ng pansin ay ang naging pana-naw ni Bueser kung bakit nga ba sa paniniwala niya’y dapat ibasura ang impeachment laban kay Arroyo.

Sa panayam ng DERETSO kay Bueser, ipinahayag nito ang kanyang kalungkutan sa naging proseso ng pagdinig sa Kongreso. Hindi ganap na nabuo ang proseso ng impeachment nang tahasang mag-walked-out at ipagtapunan pa ng ilang mga opposition congressmen ang mga dokumentong may kinalalaman nga sa impeachment.

“Tagisan ng katwiran at paninindigan ang Bulwagan ng Kongreso. Bilang abogado at isa ngang mambabatas, tungkulin ko na suriing mabuti ang mga isyung bumabalot sa anumang usapin. Nakahanda na ako noon na bigyang halaga ang kabuuan ng impeachment, subalit nang maganap nga ang walked-out at ang paghahagis ng mga dokumento sa gitna ng mainit na pagtatalo ay gumuho ang aking paniniwala na panigan iyon,” ayon kay Bueser.

Hindi nakaiwas si Bueser sa negatibong pagpuna ng iilang tutol sa pagbasura nga sa impeachment. Sa lunsod na ito lamang ay kumalat ang ilang streamer na tahasang tumuligsa, hindi lamang kay Bueser, ngunit pati na rin kay Arroyo.

“Mamamayan ng ika-3 distrito ng Laguna, kumilos, lumaban, patalsikin si Gloria-Bueser” “Bueser magkano mo ibinenta ang tindig ng ika-3 distrito ng Laguna? 5 milyon at 45 milyon CDF ba?” Ayon sa ilang naglabasang streamer na ikinabit sa mismong pusod ng lungsod na ito. Hibong may “kalayaan” pa sa lungsod na ito kaya’t doon nga sa mismong pusod ng lungsod ibinandera ang nasabing mga streamer. Kaya naman hindi maiwasang isipin ng mga tagalunsod: “Nasa likod ng mga streamer na iyon ang kasalukuyang liderato ng San Pablo na nakipagkutsaba sa progresibong samahan dahilan lamang sa maduming laro sa pulitika.”

Taliwas naman ang sinasabi ng ilang streamer na iyon sa opisyal na pahayag ng limang mayor mula sa 3rd District.

“Congratulations on your excellent performance as Representative of our district during the impeachment debate at the House Committee on Justice as well as the articulation of your ‘yes’ vote at the plenary session,” ayon sa sulat na ipinadala ni Alaminos Mayor Samuel F. Bueser.

“Your impartial upholding of the law during the impeachment debate of the House Committee on Justice and your articulation of the YES vote at the plenary session hall has brought unity to the country in upholding the constitution and the law,” ayon kay Calauan Mayor Buenafrido Berris.

“The municipality would like to extend our sincere appreciation for your commendable effort in support to our Honorable President of the Republic, Her Excellency Gloria Macapagal-Arroyo on her battle to uplift the morale of this nation and provide a better life for the Filipinos,” ayon kay Liliw Mayor Cesar Sulibit.

“Ang inyo pong lingcod ay buong pusong sumusuporta sa paninindigan n gating mahal na Kinatawan – Kgg. Danton Bueser sa nakaraang plenary session,” ayon kay Nagcarlan Mayor Rosendo Corales.

Para sa mamamayan ng ikatlong distrito

Paninindigan batay sa reyalidad. Ito ang isa sa malalim na pinagbatayan ni Bueser nang sabihin nga niyang, “Oo” dapat ibasura ang usapin ng impeachment. Na sa dako pa doo’y kahulugan din ng “oo” na dapat hindi maputol ang daloy ng pagpapaunlad ng bansa, lalo na ang mga nasa kanayunan.

“Nakasalalay dito ang mga proyektong sabay nating pinangarap simula pa nang katawanin ko ang ating distrito halos siyam na taon na rin ang nakaraan,” ayon kay Bueser.

Isa nang reyalidad sa sistema ng politika sa ating bansa na laging nakasalalay sa kung sino ang namumuno sa sentro ng kapangyarihang pulitikal ang anumang proyektong makapagpapaunlad sa bansa at kanayunan. At isa nga ito sa pinagbatayan pa rin ni Bueser.

Nakaplano na ang halos isang bilyong pisong proyekto sa 3rd district na siyang magiging katuparan sa binuong sama-samang panaginip, halos siyam na taon na rin nga ang nakaraan: San Pablo City-Lipa City National Road; Alaminos-San Pablo City Diversion Road; Calauan-Liliw Provincial Road; Calauan-Nagcarlan Provincil Road; suporta sa mga farm inputs ng magsasaka; suportang gamit pangaisdaan ng mga mangingisda sa baybayin ng bayan ng Victoria; atbp.

Lahat ng mga government projects ay nakalaan sa mamamayan. Tulay lamang ang mga opisyales ng pamahalaan upang matupad ang anumang proyekto. Kaya nga’t bukod sa paggawa ng mga kaukulang batas, nakatuon din ang isipan ni Bueser sa ganap na pagpapatupad ng mga kaunlarang iyon. At ito nama’y unawa ng limang mayor sa 3rd district na ipinarating pa rin nila kay Bueser.

Umalma na ang miyembro ng Federation of San Pablo Market Retailers, Inc. (SPMRI) hinggil sa diumano’y “panggigipit ng kapi-tolyo” na magbayad sila ng “bente pesos na market fee” araw-araw at kung hindi’y ipa-padlock ang kanilang stall. Napag-alaman pa rin nila na sisingilan sila ng P10,000.00 per square meter para sa rights.

SERVICE ROAD. Minsan na ring napabalik ito sa mga namamalengke sa panahon ni dating Mayor Boy Aquino. Ngayon, muling naangkin ito ng mga ambulant vendors. Maibalik pa nga kaya ito sa mga mamamayan?

“Papaano kami kikita ‘eh hanggang ngayon ang gulo ng operasyon ng palengke?,” ayon sa ilang miyembro ng pedersayon.

Dahilan doon, sa pamamagitan ni Atty. Venancio M.Villanueva, legal counsel ng pederasyon, pormal silang nagpadala ng sulat kay Mayor Vicente B. Amante at inihayin ang kanilang mga karaingan.

Minarapat ng DERETSO na ilathala ang nasabing liham para na rin sa kabatiran ng mga miyembro ng pederasyon at publiko. Ika-27 ng Setyembre 2005 ang petsa ng nasabing liham.

Dear Mayor Amante,

Our client the Federation of San Pablo Market Retailers, Inc. (SPMRI) which members numbering 771 legitimate stall holders at the public market, and all victims of the 1992 fire ,who are paying religiously their dues is requesting your office to look into the following matters affecting it’s members peaceful occupancy of their respective stall which endanger their means of livelihood and subject them from harassments from ambulant vendors who are being tolerated by the City Government inspite of their flagrant violation of the market code approved by the City, to wit:

1. Of all ambulant vendors only 32% are from San Pablo City – meaning the rest don’t vote nor pay taxes in the city.

2. As per Treasurer’s record only 62 are legitimate ambulants.

3. This condition – meaning ambulants occupying the service road, lobby, Paterno St. sidewalks of Regidor and Flores Sts. had been in existence since 1998 – up to the present, was cleaned for a while during Mayor Aquino’s term but came back with a vengeance after last election.

4. The lobby which should have been a communal space to be used partly as precinct for both police and PSAF (since no space was provided in the whole public market for these peace and order personnel) is fully occupied by ambulant vendors obstructing the elevator doors.

5. Service Road was designed and intended to be used for loading/unloading of merchandise and the buying public.

6. Ambulants create so much ear splitting noise due to non-stop simultaneous playing of CD tapes of vendors, showing pornographic tapes in their stalls for public viewing, chaos, dirt, snatching, unruly behaviour like public display of gambling, beer drinking spree.

7. Rugby boys do their thing right in front of the PSAF ( Public Safety Assistance Force) causing concern and fear for the buying public.

8. There is so much illegal electrical tapping which might cause fire.

9. The first floor of the the newly constructed Mall 2 is more than spacious to house all the above mentioned ambulant vendors.

10. In the meantime that the aforementioned problems have not been resolved payments of daily stalls are being collected and deposited to the bank as sign of good faith of SPMRI.

We would like to refer your office to Section 28 of the Market Code which provides :

“SECTION 28. USE OF SIDEWALK AND HALLWAY – Unless otherwise specified aisles (pacillos) sidewalks, path spaces intended for people to pass should not be used by stallholders and ambulant vendors for displaying their wares or merchandise. It is the duty of the Market Superintendent or his representatives to see to it that this section shall be strictly implemented by the stall holders and ambulant vendors. Violation of this section shall be punished by a fine of five pesos (P5.00) but not more than fifteen pesos (P15.00) or imprisonment of five days but not more than fifteen (15) days or both a discretion of the court.”

In this request therefore and in the interest of justice may we request your office to immediately take action on the complaints of our Clients.

San Pablo City – Sa kabila ng mariing pagbabanta ng Department of Environment and Natural Resources (DENR) na kakasuhan sa Korte si Mayor Vicente Amante kapag ‘di nito isinara hanggang Pebrero 2006 ang kasalukuyang dumpsite ng lungsod na ito sa Sitio Balok. Brgy. Sto. Niño, ay inapbrubahan naman ng Sangguniang Panglunsod ang mahigit 20 milyong pisong pagbili ng nasabing lugar.

Maigting na isinulong ni Konsehal Diosdado Biglete, chairman ng solid waste management committee, ang nasabing pagbili nga ng lupain noong nakaraang sesyon ng Konseho ng Oktubre 18. At sa sesyon naman ng Oktubre 25, inaasahang aaprubahan ng mayoryang miyembro ng Konseho ang Item No. 2005-424 para sa 1st endorsement upang mapagtibay na ang Contract to Sell sa pagitan nina Amante, bilang kinatawan ng lokal na pamahalaan at isang Lilim Cabrera, Jr., kinatawan ng may-ari ng nasabing dumpsite.

Dalawang parsela iyon ng lupa na may sukat na 30,543 square meters at bibilhin ng lokal na pamahalaan sa halagang PhP 10,079,190.00 at 31,000 sq.m. na nagkakahalaga naman ng PhP 10,230,000.00.

Ayon sa dalawang Contract to Sell, mismong lokal na pamahalaan ang siyang nag-alok sa mga Cabrera na bibilhin nga ang nasabing lugar sa ganoong halaga na huhulugan ng pamahalaan sa nalolooban ng anim na buwan.

Magbabayad agad ang lokal ng pamahalaan ng tig-iisang milyong piso para sa nasabing dalawang parsela ng lupa kapag ganap ng naratipika ng Konseho ang nasabing Contract to Sell.

Mahigit naman sa tig-aapat na milyong piso ang susunod na bayaran sa buwan ng Enero 2006 at panibagong mahigit uli sa tig-aapat na milyong piso sa Mayo 2006.

Pawang mga oja lamang ang kaukulang dokumento na hawak ng may-ari ng nasabing mga lugar at wala pa rin itong ganap na titulo ng lupa. Nakasaad naman sa nasabing Contract to Sell na ang nagbebenta ang siyang gagastos sa pagsasaayos upang magkaroon na nga iyon ng titulo na ipapangalan sa bumili.

Paglilinaw ni Ynares

Sa magkahiwalay na sulat kina Amante at Konsehal Ivy Arago noong buwan ng Setyembre 2005 ni Laguna Lake Development Autthority (LLDA) General Manager at Executive Director of the National Solid Waste Management Committee Dr. Casamiro A. Ynares III, nilinaw ni Ynares na ang rekomendasyon na nakasaad sa July 20, 2005 ay tanging para lamang sa operasyon ng Sanitary Landfill (SLF) at kailangang maghanap ang siyudad ng alternatibong paglalagayan noon sapagkat hindi na nga puwedeng gamitin ang kasalukuyang dumpsite maliban na lamang bilang isang controlled dumpsite bago ganap na sarhan nga ito sa Pebrero 2006.

Pag-aaral ng Mines and Geosciences Bureau

Taliwas naman ang sulat na iyon ni Ynares sa naging resulta ng pag-aaral noong Mayo 2005 ng mga taga-Mines and Geosciences Bureau (MGB), isang ahensya ng pamahalaan na nasa ilalim ng DENR.

Ayon sa executive summary report ng MGB: “With sound additions of engineering and environmental measures, the present open dumpsite of San Pablo City in Brgy. Sto. Niño does not need to be transferred elsewhere. Based on the results of environmental geological investigation, the site location of the existing dumpsite and its propsed expansion areas generally qualifies for sanitary landfill. The site location has least obstacles to overcome the development and conversion of the existing dumpsite into controlled dump and eventually into sanitary landfill.”

Pananaw ng DERETSO

Sa gitna ng kung sino nga ba ang dapat sundin: si Ynares na executive director ng national solid waste at undersecretary ng DENR o sina Javelosa ng MGB, asahang talagang papaspasan ng grupo ni Amante na mabili ang lupa upang kahit papaano’y may mapagbaak-baakan bago magpasko’y.

Matatandaan na magtatapos din ng taong 2004 nang hapiting maipasa ang 25.6 milyong pisong ipinambili sa walang titulong 3.05 ektaryang lupa sa may Brgy. San Jose.

Ito na nga ba ang tatak ngayon ni Amante: ilugmok sa utang ang siyudad?
